Approval of Amendment C40quen – Fisherman’s Flat Heritage Review

Amendment C40quen was approved by the Minister for Planning on 27 May 2025 and provides strengthened heritage protections into the Queenscliffe Planning Scheme relating to Fisherman’s Flat. 

The amendment implements the recommendations of the Heritage Review of Places in Fisherman’s Flat Urban Conservation Precinct (HO1), Fisherman’s Flat, Queenscliff, Victoria (Ecology and Heritage Partners, October 2024) with the following changes to the Planning Scheme:

  • Amendment to the Schedules to Clause 43.01 (Heritage Overlay).
  • Clause 72.04 (Incorporated Documents) to update the Fisherman’s Flat Urban Conservation Precinct Heritage Design Guidelines.
  • Introduces a Statement of Significance for Fisherman’s Flat.
  • Inserting the review report as a background document in the Schedule to Clause 72.08; and
  • Consequential changes to Heritage Overlay map and schedule.

Amendment C40quen

Background:

Council engaged Ecology and Heritage Partners to undertake a review of the heritage values of Fisherman’s Flat. Ecology and Heritage Partners were asked to:

  • Review existing citations for places within Fisherman’s Flat
  • Review the recommendations of the BoQ Planning Scheme Review (Lovell Chen 2021) as they relate to Fisherman’s Flat 

  • Confirm or modify the ‘contributory’ and ‘non-contributory’ classifications within Fisherman’s Flat

  • Assess previously unidentified heritage buildings 

A draft of the review, by Ecology and Heritage Partners, was made available to allow the community to review and offer feedback. An in-person consultation session was held at the Queenscliff Hub on 9th March 2023.

A number of written submissions were received in response to the request for feedback on the draft document. Submissions were forwarded to Ecology and Heritage Partners who reviewed and made changes and corrections.

The review was formally reported to Council at the Ordinary Meeting on 25 October 2023 with Council seeking authorisation from the Minister for Planning to prepare an amendment to the Queenscliffe Planning Scheme.

 

Background to Planning Scheme Amendment C40quen

On the 22nd of January 2024, the Minister for Planning authorised the preparation of an amendment to the Queenscliffe Planning Scheme.  Authorisation does not indicate Ministerial support for the amendment but does enable preparation and exhibition of the amendment in accordance with the requirements of the Planning and Environment Act 1987. 

Exhibition of amendment C40quen commenced on 7 March 2024 and concluded on 12 April 2024 in accordance with the requirements of the Planning and Environment Act.  During the exhibition period twelve submissions were received.

At the Ordinary meeting on 22 May 2024, Council resolved to request that the Minister for Planning appoint a panel to hear the submissions. A panel was appointed, and an online panel hearing was held on the 6th of August with the findings of the Panel publicly released on 9 September 2024.

The panel report contains recommendations on strategic justification, the drafting of the amendment and issues raised in submissions and was considered at a Special Meeting of Council on 17 September 2024.  Council resolved to receive the Panel Report, accept all recommendations in full and directed a final package for amendment documents be prepared for consideration at an Ordinary meeting of Council in November 2024.  

At the Ordinary meeting on 27 November 2024 Council resolved to formally adopt Planning Scheme Amendment C40quen for approval by the Minister for Planning and for incorporation into the Queenscliffe Planning Scheme.
